These Terms and Conditions ("Terms") govern your use of our website and the purchase of products from our online store. By accessing our website or making a purchase, you agree to be bound by these Terms.

1. Acceptance of Terms
By using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein.
2. Changes to Terms:
Game Apparel reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website or purchase of products after such changes constitutes your acceptance of the new Terms.
3. Eligibility:
To use our website and make purchases, you must be at least 18 years old and have a B2B Resale certificate. By using our website, you represent and warrant that you meet these eligibility requirements.
4. Account Registration:
To purchase products from our online store, you may need to create an account. You agree to provide accurate and complete information during the registration process and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Online Orders & Payments:
- Order Acceptance: All orders placed through our website are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in product or pricing information, or issues identified by our fraud detection system.
- All Stock Orders: Orders placed and received into our system by 3:00 PM ship the same day as long as there are no logistical issues.
- Pricing and Payment: All prices are listed in U.S. dollars and are subject to change without notice. Payment is due at the time of purchase. We accept major credit cards and other payment methods as indicated on our website.
6. Custom Order Production Time:
- Decorated Stock Products: 2-5 days proof process, plus 2-4 weeks production time
- Blank Custom Products: 3-4 weeks, allow extra time for peak season.
- Decorated Custom Products: 2-5 days proof process, plus 4-6 weeks production time.
- Decoration and Custom Order Production times are estimates and will vary depending on various custom order and decoration specifications such as: type of embellishment, quantity of order, variety or combination of embellishments, complexity, and season.
7. Billing & TERM Accounts:
NET 30 days for established accounts. All orders will be shipped subject to credit approval. A $40 service charge is assessed for all returned checks. Past due invoices will be assessed an interest charge of 1.5%/month, an 18% annual rate.
8. Shipping and Delivery:
- Shipping: We offer various shipping options, which will be displayed at checkout. Shipping times and costs may vary depending on your location and the shipping method selected.
- Delivery: While we strive to meet our delivery estimates, we are not responsible for delays caused by factors beyond our control, including but not limited to carrier delays, customs processing, or weather conditions.
9. Returns and Refunds:
- Returns will not be accepted without a Return Authorization Number (RA#) clearly marked on the box of merchandise being returned. Contact Customer Service for a return authorization number within 10 days of receipt of merchandise.
- Return claims made within 10 days of receipt of merchandise will receive no restocking fee.
- Return claims made after 10 days of receipt of merchandise will receive a 20% restocking fee.
- Return authorizations will not be issued after 30 days of receipt of merchandise.
- All returns are subject to a $.50 bag replacement fee plus freight charges.
- Returns must be shipped back to GAME within 30 days of the date the RA# was issued. Returns will not be accepted and credit will not be issued for merchandise received after 30 days of the date the RA# was issued.
- Reimbursement for returned merchandise will be issued in the same form of payment or credit at GAME’s discretion, in addition, credit may be applied to any outstanding A/R and will not be issued to delinquent accounts.
- Health Department regulations stipulate that all merchandise returned for repair or credit must be cleaned or washed if it has been worn. A $50.00 surcharge per garment will be assessed should GAME need to have the garment cleaned.
- Custom orders, decorated goods, closeout merchandise, and sample orders cannot be returned for credit.
- Orders placed online and phone orders that have shipped cannot be canceled.
11. Backorder Policy:
- Back orders may be placed only for items that are currently out of stock.
- For customers paying by credit card, payment for backordered items will be captured at the time the backorder is placed. This allows GAME to reserve inventory and ensure prompt fulfillment once the merchandise becomes available.
- All backordered merchandise is priced based on the pricing in effect at the time the backorder is placed.
- Promotional pricing or discounts will apply only if they are active at the time the backorder is submitted.
- Backorders will ship free freight within the contiguous United States if the original order qualified for free freight.
- If the original order did not qualify for free freight, applicable freight charges will be billed proportionally based on the items that were backordered.
- Shipping methods are determined at GAME’s discretion. Customers will receive a confirmation email when the backorder is processed and a shipment notification once the backorder has shipped.
- Backorders will not be accepted for discontinued items, closeout merchandise, custom apparel, catalogs, or custom-hemmed pants.
- Fulfillment of all backorders is subject to product availability. Any estimated time of arrival (“ETA”) provided is an approximate estimate only and reflects when GAME expects to receive the merchandise.
- GAME is not responsible for delays or failure to fulfill backorders resulting from supplier shortages or circumstances beyond our control.
12. Color/Shade Variance:
Colors vary from dye lot to dye lot. Game Apparel makes every effort to match within an order whenever possible, but makes no guarantee of an exact match.
13. Intellectual Property:
All content on our website, including text, graphics, logos, images, and software, is the property of Game Apparel or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, distribute, or display any content without our prior written permission.
14. Limitation of Liability:
To the fullest extent permitted by law, Game Apparel shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or purchase of products, including but not limited to loss of profits, data, or other intangible losses.
15. Indemnification:
You agree to indemnify and hold harmless Game Apparel, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or in connection with your use of our website or violation of these Terms.
16. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be resolved in the state or federal courts located in Yorktown Heights, New York.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
